The legislation clearly separates these technical marking duties from the visible disclosures that deployers are obliged to provide to their audiences. Deployers must identify deepfake images, audio, and video that could be mistaken for authentic material. They are also responsible for labeling AI-generated texts published for the purpose of informing the public on issues of public interest. The requirement for labeling does not apply after a human review or editorial oversight when a person or organization assumes editorial responsibility. All necessary information must be presented clearly, distinguishably, and accessibly. Differences between machine markings and public disclosures are emphasized.
